Terms of Service

trademagic is operated by Alien Media Pty Ltd (ABN 38 634 304 840), a company registered in Australia. In these terms, trademagic (also we, us, or our) means Alien Media Pty Ltd, which also bills for subscriptions. By creating an account or using trademagic (the Service) you agree to these Terms of Service. If you do not agree, do not use the Service.

We may update these terms from time to time. Material changes will be notified through the Service or by email, and your continued use after a change takes effect means you accept the updated terms.

1. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Service. You are responsible for complying with the laws that apply to you, including any rules about trading or receiving trading-related information where you live.

2. What trademagic is

trademagic provides trading signals, alerts, market information, and a read-only API for consuming signals in your own tools. Signals are generated using quantitative methodologies that we believe are sound, but markets are inherently uncertain and no methodology can predict the future or guarantee any result.

The Service does not execute trades, does not connect to your broker accounts, and does not hold, transfer, or have any access to your funds. Anything you build on the API runs on your own systems and under your own control.

3. Not financial advice

The Service provides general information only. It does not take into account your objectives, financial situation, or needs, and it is not personal financial, investment, legal, tax, or accounting advice and must not be relied on as such. Nothing in the Service is an offer, recommendation, or solicitation to buy or sell any financial product. Before acting on any signal or information, consider whether it is appropriate for you and obtain your own independent, licensed advice. Past performance is not a reliable indicator of future performance.

4. Your trades are your responsibility

Any trading happens outside the Service, in accounts you hold with your broker. You are solely responsible for every decision made and every order placed in those accounts, whether you place it yourself or software you build, run, or configure (for example a bot consuming our API) places it. You choose your risk settings, position sizes, and which signals (if any) to act on, and you remain responsible for your broker relationship and any broker fees.

5. Subscriptions, billing, and price

Access to paid features requires a subscription billed by Alien Media Pty Ltd through our third-party payment processor (currently Stripe). Subscriptions are billed in advance on a recurring basis and renew automatically until you cancel. By subscribing you authorise us to charge your payment method for each renewal until cancellation. We may change prices or plan features; we will give reasonable notice before a change affects your next renewal, and continuing past that date accepts the new price.

6. Cancellations and refunds

You can cancel at any time from the Billing page. Cancellation stops future renewals, and your access continues until the end of the period you have already paid for. Fees already paid are non-refundable, and we do not provide refunds or credits for change of mind, for partial or unused billing periods, or because signals or trades did not produce a particular result, except where a refund is required by law. Nothing in this section limits any rights you have under the Australian Consumer Law that cannot be excluded. See our Refunds Policy for detail.

7. Acceptable use

You agree not to: share your account, your API key, or resell access; copy, redistribute, or republish signals or other content except for your own personal use; attempt to reverse-engineer our methodologies; scrape or place automated load on the Service beyond normal use (including exceeding published API rate limits); or use the Service unlawfully or in any way that harms us or other users.

Subscriptions cover personal use. If you want to use the Service or the API in a commercial product or any other capacity, contact us to discuss a custom plan before doing so.

8. Accounts and security

You are responsible for keeping your login credentials, two-factor codes, and API keys confidential, and for all activity under your account. Tell us promptly if you suspect unauthorised use. We may suspend or terminate access for breach of these terms, for non-payment, or where we reasonably need to protect the Service or other users.

9. Availability and warranties

We work to keep the Service reliable, but it is provided on an as-is, as-available basis. To the extent permitted by law, we do not warrant that it will be uninterrupted, error-free, or secure, or that signals or data will be accurate, timely, or complete. Market data and delivery channels depend on third parties outside our control.

10. Limitation of liability

To the maximum extent permitted by law, trademagic and Alien Media Pty Ltd are not liable for any trading or investment losses, or for any indirect, incidental, special, or consequential loss (including lost profits, lost opportunity, or loss of data), arising from your use of or reliance on the Service.

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability for failing to comply with such a guarantee can be limited, our liability is limited, at our option, to re-supplying the relevant service or paying the cost of having it re-supplied. To the extent we may otherwise be liable, our total liability for all claims is limited to the subscription fees you paid us in the 3 months before the event giving rise to the claim.

11. Intellectual property

trademagic, its name and logo, the software, and the signals and content we provide are owned by Alien Media Pty Ltd or its licensors. We grant you a limited, personal, non-transferable right to use them for your own use of the Service. You may not copy, modify, distribute, or create derivative works except as these terms allow.

12. Governing law

These terms are governed by the laws of Australia and of the State or Territory in which Alien Media Pty Ltd has its registered office, and you submit to the non-exclusive jurisdiction of the courts of that place.
